Please read these terms carefully before using Calibur. By accessing or using the platform, you agree to be bound by these terms.
Acceptance of Terms
By creating an account, accessing, or using Calibur (the "Platform"), you confirm that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms"), as well as our Privacy Policy. If you do not agree to these Terms, you may not access or use the Platform.
These Terms constitute a legally binding agreement between you ("User") and Calibur ("we," "us," or "our"). You represent that you are at least 18 years of age and have the legal authority to enter into this agreement.
We reserve the right to update or modify these Terms at any time. We will notify users of material changes via email or a prominent notice on the Platform. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
Description of Service
Calibur is a professional skills assessment platform that enables users to complete timed business writing challenges and receive performance-based scores. The Platform allows users to build a verifiable skills portfolio and participate in a broader community of assessed professionals.
Our services include:
- Timed business writing challenges across various formats and difficulty levels
- Automated scoring and feedback across assessed performance dimensions
- A personal portfolio displaying scored challenge submissions
- Leaderboard rankings among the Calibur community
- Access to challenge results and performance history
We may update, modify, or discontinue features of the Platform at any time. We will make reasonable efforts to communicate material changes in advance.
Account Registration
To access the Platform, you must create an account using accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to:
- Provide truthful information during registration, including your professional background
- Keep your account information current and accurate
- Notify us immediately of any unauthorized use of your account
- Maintain the security of your password and not share access with others
- Use the Platform only under your own account and not on behalf of another person
We reserve the right to suspend or terminate accounts that contain false information or that we reasonably believe have been compromised or misused.
Platform Integrity Rules
The integrity of Calibur scores depends on each user completing challenges honestly and independently. The following conduct is strictly prohibited and may result in immediate account suspension or permanent ban:
- Sharing challenge prompts, content, or your responses with others during an active challenge window
- Submitting work that was not written by you during the challenge session
- Using unauthorized assistance beyond what is permitted for the designated challenge format
- Attempting to manipulate, reverse-engineer, or exploit the scoring system
- Creating multiple accounts to circumvent submission or attempt limits
- Misrepresenting your professional background or credentials on your profile
We reserve the right to investigate suspected violations and to make final determinations regarding integrity breaches at our sole discretion. Users found in violation may have their scores adjusted, removed from rankings, or have their account terminated without refund.
Scores and Ratings
Calibur scores are generated through a proprietary assessment methodology. By using the Platform, you acknowledge and accept the following:
- Scores reflect assessed performance on specific challenges and are not a comprehensive measure of professional skill or potential
- Only first-attempt submissions are eligible to count toward your publicly visible rating. Retakes are permitted for practice but will not update your public score
- Scoring methodologies may be updated over time to improve accuracy and fairness
- Calibur does not guarantee that scores will be recognized or accepted by any third party, including employers
- Scores are the property of Calibur and may be displayed on your public profile unless you request otherwise
We reserve the right to recalibrate, adjust, or remove scores in cases of platform updates, integrity violations, or errors in the scoring system.
Intellectual Property
All content, features, and functionality of the Platform, including but not limited to challenge prompts, scoring frameworks, design elements, branding, and software, are owned by Calibur and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for its intended purposes. You may not:
- Copy, reproduce, distribute, or republish challenge content without our written consent
- Reverse-engineer or attempt to extract the scoring methodology or underlying systems
- Use Platform content or branding for commercial purposes without authorization
- Scrape, crawl, or systematically extract data from the Platform
Any feedback, suggestions, or ideas you provide regarding the Platform may be used by us without obligation or compensation to you.
User Content
When you submit a challenge response or other content to the Platform, you grant Calibur a non-exclusive, royalty-free, worldwide license to store, process, display, and use that content for the purposes of operating and improving the Platform.
You represent and warrant that:
- You are the original author of submitted content and have the right to grant this license
- Your submissions do not infringe on the intellectual property rights of any third party
- Your submissions do not contain unlawful, offensive, or harmful content
We will not sell your individual submissions to third parties. Aggregated, de-identified performance data may be used for research or product development purposes.
Privacy and Data
Your use of the Platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.
By using the Platform, you consent to the collection and use of your data as described in our Privacy Policy, including:
- Account information such as name, email, and professional background
- Challenge submission content and performance data
- Usage and behavioral data to improve the Platform
- Communication preferences and interaction history
You may request deletion of your account and associated personal data at any time by contacting us. Note that aggregate, de-identified data may be retained even after account deletion.
Disclaimers
The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Calibur disclaims all warranties, express or implied, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement
- That the Platform will be uninterrupted, error-free, or free of viruses or other harmful components
- That scores or assessments will accurately reflect your professional capabilities
- That challenge results will influence hiring outcomes or professional advancement
We do not warrant that the Platform will meet your specific requirements or that any errors will be corrected. Use of the Platform is at your own risk.
Limitation of Liability
To the maximum extent permitted by applicable law, Calibur and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or business opportunities
- Loss of data or inability to access your account or submissions
- Hiring or employment outcomes related to your Calibur scores
- Unauthorized access to or use of your account
- Interruptions or errors in Platform availability
Our total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the greater of (a) the total fees you paid to Calibur in the twelve months preceding the claim, or (b) fifty US dollars ($50).
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
Termination
You may terminate your account at any time by contacting us or using account settings. Upon termination, your right to access the Platform will cease immediately.
We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have:
- Violated these Terms or our integrity rules
- Engaged in fraudulent or abusive behavior
- Provided false or misleading account information
- Taken actions that may expose Calibur to legal liability
Upon termination for cause, we are not obligated to retain or provide access to your submitted content or historical scores. Sections of these Terms that by their nature should survive termination shall continue to apply.
General Provisions
Governing Law. These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
Dispute Resolution. Before initiating any formal legal proceedings, you agree to contact us in good faith to attempt to resolve any dispute. We will make reasonable efforts to address your concerns within 30 days of receiving written notice.
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Calibur with respect to the Platform and supersede all prior agreements.
No Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
